What is a Red Flag Law?
Although the names can differ from state to state, “Extreme Risk Protection Order” is the name most formally used to describe what most people, and certainly the media, refer to as a “Red Flag Law”. Red Flag Laws allow a family member, law enforcement official, or a significant other (current or former) to petition a judge to order the confiscation of firearms from a person who is believed to be a threat to themself or others.
Why are Red Flag Laws problematic for gun owners?
In most cases, the hearing to determine whether to confiscate firearms from an individual usually occurs WITHOUT the accused individual present. It is essentially a restraining order or a no contact order issued against an individual’s property–his or her firearms. After the firearms have been confiscated, the accused individual will then have the opportunity to clear his or her name at a hearing where he or she is actually present. In the meantime, the accused cannot possess or purchase firearms.
What if the accused is unable to prove that he or she is not a danger to themselves or others? Then, the firearms will remain confiscated by the authorities. All the while, the accused individual is incurring legal costs to defend themselves, even though no crime has been committed that would require forfeiture of firearms. Even if a crime is NEVER committed, the confiscated firearms can remain in the custody of the authorities.
So, in a Red Flag Law situation, your right to keep and bear arms may be taken from you, based only on an allegation.
How does Firearms Legal Protection membership help?
In the event that you become a respondent to a validly issued Red Flag Law order that results in the confiscation of your firearms, Firearms Legal Protection will provide you with an attorney to represent you in any legal proceeding resulting from the issuance of such an order.
